After all these years in ministry, I have discovered that if one asks 100 pastors how they handle marriage and divorce, one will get 100 different responses! :-) But, my understanding has been heavily influenced by Spiros Zodhiates's book, 'What about Divorce?'. To summarize what he says, the bill of divorcement was only given in cases where a person was not guilty of adultry. The bill of divorcement cleared them of any wrongdoing and allowed them to remarry. However, most husbands did not give a bill of divorcement, even when the wife was not guilty of adultery. Thus, they were considered adulterous. This is what Mt. 19:9 seems to be saying. The verbs translated as 'commit' are actually passive in voice. A better translation would be 'adulterated'. He argues that the innocent party is suspected of adultry, but did not actually commit adultery.
