I offer my opinion. First off the answers about the morality of your divorce are on target. The Bible does address adultry as reason for divorce. I do not interpret it to say it must be ongoing. Is one a sinner only when sinning at that moment, no..one is a sinner untill repenting. I have been through a situation very much like this and I offer my deepest condolences for your situation. Look at another angle on this. Your wife has sinned against the covenant she made with God in regards to your marriage. You are the spiritual leader to your childern. Your children deserve the chance to grow up in a home that offers a morally and spiritually nuturing environment. If you are married to a non-believer that is non-repentant of her sins against God and you, it is your duty to your children to fight for the ability to raise them in the environment described above (in my opinion). But mind this one condition: This is only, and I cannot stress enough ONLY if your wife refuses to try to work this out. This is an extreme last resort. By the grace of God my marriage was saved in the eleventh hour (2 hours before the hearing to finilize the divorce). Perhaps my best suggestion: Prey, God will guide you through this. Trust in the preacher you know and have faith in. Legally, do this. Speak with a few lawyers TOMORROW, and ask if it will be detramental to your case if you file for divorce. In some states, as in mine Oklahoma, when the man files or moves out of the house it can be a stumbeling block in seeking custody -- as it is seen as a form of abandonment by some judges. You may also ask if filing for seperation carries a similar stigma. If not you may do that and then inquire as to if you can file some injunction forbidding her from taking the childeren and moving. One widespread fact is that in most places custody hearings favor the mother even more if she is a resident of the jurisdiction but the father lives elsewhere. You want this hearing to take place there, where you live now. My prayers are with you. |
